Please read the terms and conditions set forth below carefully. Terms and Conditions 1. Object The present Terms and Conditions govern the sale of Tickets (as defined below) for events, concerts and performances, made by Arzanà Events (as defined below). 2. Definitions In these Terms and Conditions the following expressions shall have the meanings set opposite them. Reference to the plural includes the singular and vice versa: Arzanà Events: is Arzanà s.r.l., a communication agency that organizes events and a travel agency, having registered office in Calle Due Portoni 6 – 30171 Mestre (VE) - Italy. Below will be called simply Organizer. Customer: is the person who makes the Ticket purchase on line, by telephone or at an authorized dealer. Ticket Holder: is the person who holds a Ticket purchased by the Customer. Event: is the show, performance and any other event to which the Ticket allows access. Ticket: is the document entitling the Ticket Holder to have access to the Venue. Venue: is the set of buildings and grounds where the Event takes place. 3. Tickets and Events 3.1 Any Ticket Holder must be in possession of a valid Ticket or IdCode to access the Venue. The rules applicable to the Customer apply to the Ticket Holder. 3.2 The Ticket must be purchased from Arzanà or from an entity authorized to sell the Tickets. In the event that Ticket is purchased from entities other than Arzanà or if the Ticket is lost, stolen, duplicated or obtained by any other means that do not comply with these Terms and Conditions, the Ticket Holder could be not allowed to access to the Venue or should leave it. 3.3 The Ticket may not be sold or subject to intermediation. 3.4 Arzanà reserves the right to cancel a Ticket and a purchase order at any time for technical and/or organizational reason. 4. Payment methods Arzanà reserves the right to apply limitations and exclusions to the payment methods used by the Customer for security reasons. 5. Waiver The Ticket price is not refundable in the event of waiver by the Customer. In case of on-line sales, the Customer is not entitled to withdraw as set forth by Article 55 of the Code of Consumer. 6. Cancelled or Postponed Event 6.1 In the event of changes to the program and/or to the time of the Event, the Ticket Holder will not be entitled to change his/her Ticket or to obtain the refund, except in the case it is otherwise decided by the Organizer. 6.2 Owing to circumstances beyond the Organizer's control, fortuitor events or if the minimum number of participants will not be reached, the Organizer will have the possibility to cancel the event. 6.3 In case of cancellation of the Event, the Ticket Holder for such Event will be entitled to request the refund, in accordance with the timing and instructions decided by the Organizer that will be communicated in case of cancellation. The Tickets concerning these Events could be changed with Tickets concerning other Events, depending on availability and after payment of the difference, if necessary. 7. Limitation of liability and Arzanà rights Except in the case of gross negligence or fraud, Arzanà shall not be liable for any cost and damage, direct and indirect, suffered by the Customer in connection with the Ticket sale. Arzanà also reserves the right to interrupt, change, suspend or terminate any service for technical and/or organisational reasons. 8. Miscellanea 8.1 If any provision of these Terms and Conditions is held unenforceable, these Terms and Conditions shall continue to be fully enforceable as to their other provisions. 8.2 The sale agreement between Arzanà and the Customer regarding the Ticket purchase shall be governed by and construed in accordance with Italian law. The Venice Law Court shall have the exclusive jurisdiction to settle any claim which may arise out of or in connection with these Terms and Conditions and the Ticket sale. 8.3 Arzanà reserves the right, in the case it is held necessary, to amend and/or integrate these Terms and Conditions. The updated version will be available on the www.arzanadv.it website or can be directly requested to Arzanà. 8.4 The Customer personal data are collected, recorded and processed by Arzanà (the Data Controller) for purposes related to the agreement execution and in order to comply with the obligations provided by Italian law and EU Regulations. The Customer shall promptly notify in writing any data changes in order to keep them up to date. The data collection is necessary for the sale agreement execution. Some data may be shared with transport companies or other subsidiaries or companies related to Arzanà. If the Customer does not want that such data are communicated to these companies in order to receive information about other products or services provided by Arzanà or by other third parties, he / she must communicate his / her refusal. The Customer may exercise the rights set forth Section 7 of the Personal Data Protection Code (certification to the existence of the data; updating, rectification, integration or deletion of the data) writing to the following address: events@arzanadv.it. 8.5 These Terms and Conditions, the rules indicated in the several stages of the on line sale process (if applicable) and the warnings on the back of the Ticket contain the entire agreement between the Customer and Arzanà.
